Application of a Danish Permanent residency
If you have been residing in Denmark, you have a residence permit. To get a permanent residence, you can begin the process at any time. It is prudent that you start your application in advance before your residence permit expires. Application for a permanent residence permit after your residence permit has expired can lead to your application being revoked and charged for living in the country illegally.
What do you do if your residence permit is about to expire? When you realize that your residence permit will expire before you get your permanent residence permit, you can apply for an extension. This will give you ample time to continue with the process. If your application is flagged down for any reason including expiration of the residence permit, you will have to leave Denmark and apply afresh. Ensuring that you update your timeline and check the expiration dates is crucial to avert the possibility of being deported and blacklisted.
Requirements
Understanding what is required of you to get a permanent residence permit to Denmark can help you plan and boost your chances of being approved. Not meeting these requirements makes the process lengthy and tiring. The most primary requirement is that you must have stayed in Denmark for six or more years.As it is the requirement, you should be holding a residence permit during your six years stay. Unless you still meet the requirements for holding this permit, you will not be eligible for permanent residence.
There is a way to have your permanent residence permit before the six years of residence – you need to meet the special requirements which will be discussed later. The minimum age for one to qualify for permanent residence is 18 years. Less than that may require you to hold a residence permit before attaining the required age. Obviously, you need to have a clean criminal record during your stay and must not have any overdue public debt.
There are standardized tests that you are required to pass before the consideration. You must pass the Danish language tests and prove your fluency in speaking. In the past (at least) two and a half years before your application, you are supposed to have been fully employed or self-employed, and still employed when your case is being processed in the immigration office. The supplementary requirements that can reduce the required years of legal residence in Denmark before applying for a permanent residence permit are:
You must pass an active citizen exam test or have shown active citizenship during your stay in Denmark
You must have been employed permanently or been self-employed for at least four years in the past four and a half years
Your taxable income in the last two years should have been a minimum of DKK 270,000 on average
You must have passed the Danish Standardized language test 3 of any other Danish language test of an equivalent or higher level
After meeting all the four supplementary requirements, you can be granted permission to live in Denmark indefinitely after residing legally in the country for at least four years. However, after meeting the basic requirements, plus two supplementary requirements, you will be eligible for permanent residence after four years.
If you don’t meet the requirements
If you fail to meet some or all of the requirements, the immigration office will not approve of your application. An exemption occurs to some of the requirements if you hold a residence permit on the basis of a family reunion or asylum; you are aged between 18 and 19 years, pensioner or early pensioner or you are a person with strong connections to Denmark.Denmark’s International obligations for allowing permanent residence can also allow you to be exempted from some of the requirements.
